Oaks v. Sears
In 2016, the Court appointed Stephan Zouras, LLP lead counsel to represent hundreds of consumers who own or once owned Sears Kenmore grills in a product defect class action.
Sears sold 287,000 units of a Kenmore brand grill in which part of the grill’s firebox was defectively designed from galvanized steel and would rust out early in service, making the grill unusable and a potential fire hazard.
Claims of the $400+ grills, include consumer fraud, breach of warranty, claims under the Magnusson-Moss Warranty Act, and state-based subclasses under Florida, Virginia, New York and Illinois law.
In 2016, both parties agreed to settlement and in 2017 over 4,100 consumers received compensation.
