NCR Employees Win Conditional Certification In Wage Lawsuit
On November 9th, 2017 Judge Manish S. Shah granted Plaintiffs’ Renewed Motion for Conditional Certification. The court’s ruling means that Plaintiffs will be able to pursue their claims for unpaid wages and overtime as a group.
Specifically, the court ordered that notice of this lawsuit be sent to all current and former Customer Engineers “CE’s” who had worked for NCR during the last three years, informing them of their right to join the case. Plaintiffs’ counsel, Stephan Zouras, LLP estimates that notice will be sent to more than 4,000 CEs.
In the lawsuit, Plaintiffs claim that NCR failed to pay them for time spent before their scheduled shifts receiving work assignments, checking routes, loading and unloading their vehicles, providing ETA’s, pre-calling customers and driving to their first job of the day.
