David has spent twenty-four years fighting to protect the rights of thousands of healthcare professionals, financial and insurance industry employees, IT professionals, franchisees, warehouse workers, restaurant workers, transportation workers, cable installers, security guards, pizza delivery drivers, consumers, and union members. David prides himself on making himself available to his clients day and night, working to understand their complaints, framing their claims precisely and aggressively pursuing the best possible result.
David has been lead counsel and co-lead counsel in dozens of significant employment and consumer matters, including:
- Turner v. Mercy Health System, the first wage and hour class action to challenge a health system’s ability to pay overtime wages calculated on a pay-period basis;
- Outlaw v. Secure Health, the first FLSA collective action to recover overtime wages for healthcare worker uniform maintenance work;
- Heindel v. Merck, the first class action accusing Merck of consumer fraud for failing to disclose the cardiovascular risks of Vioxx; and
- Cirulli v. Hyundai Motor America, a class action that caused Hyundai to implement a massive, nationwide recall to replace rusting sub-frames in millions of vehicles.
