We represent Indian nationals who were employed by Capgemini North America, Inc. and Capgemini Financial Services USA, Inc. in the United States to perform IT work for Capgemini clients.
Plaintiffs and their beneficiaries participated in and received health insurance benefits under Capgemini’s Group Health Plan. Plaintiffs allege that Defendants violated ERISA, by failing to provide them election notice and continuation coverage as required by the Consolidated Omnibus Budget Reconciliation Act of 1985 (“COBRA”).
Following extensive litigation in a certified class action, United States District Judge Matthew Kennelly recently approved a $990,000 settlement to resolve the class action in Illinois.← Back to Cases
