Federal District Court Awards Conditional Certification to Bayada Home Health Clinicians in Class Action Lawsuit to Recover Overtime Wages

Stephan Zouras, LLP, a recognized national leader in securing unpaid overtime wages for Home Health Clinicians, is prosecuting a nationwide class and collective action on behalf of thousands of home health Registered Nurses, Physical Therapists, Occupational Therapists, Speech Language Pathologists and Medical Social Workers who claim were misclassified as “exempt” from the Fair Labor Standards Act and state law.

Plaintiffs contend that Bayada’s Home Health Clinician pay plan violates the FLSA and does not provide for payment of any overtime premium wages for any work performed in excess of 40 hours in any workweek. As a result, Plaintiffs contend that Bayada wrongly withheld many millions of dollars in earned overtime wage from their dedicated Home Health Clinicians, who routinely work 50, 60 or more hours each workweek.

Stephan Zouras, LLP recently secured an order from the Federal District Court for the Middle District of Pennsylvania granting Conditional Certification and Issuance of Notice to several thousand Home Health Clinicians who worked for Bayada anywhere in the United States since May 25, 2015.

Those who have worked for Bayada as Registered Nurses, Physical Therapists, Occupational Therapists, Speech Language Pathologists, Medical Social Workers, and in other similarly-designated skilled care positions, who provided health care services to their patients in their homes will now have the opportunity to join this case seeking to recover their unpaid, earned overtime wages.
