Our firm, along with Erik H. Langeland, P.C. and Cuneo, Gilbert & LaDuca, LLP, represents current and former Call Center Employees employed by IBM, who claim that they were not paid for all time worked, including overtime compensation. Plaintiffs allege that they worked off-the-clock, including booting up their computer system, initializing software applications, and performing other work before the start of their scheduled shift without proper compensation, including overtime pay. Plaintiffs claim Defendant failed to keep accurate time records of time actually worked by its employees in violation of the Fair Labor Standards Act “FLSA”. Plaintiffs are seeking to recover unpaid wages, liquidated damages and attorneys’ fees.
