Our firm, along with co-counsel Erik H. Langeland, P.C., represents current and former Call Center Employees employed by IBM, who claim that they were not paid for all time worked, including overtime compensation. Plaintiffs allege that they worked off-the-clock, including working through break times, booting up the computer system, initializing software programs, and engaging in work related telephone calls without proper compensation, including overtime pay. Plaintiffs claim Defendant failed to keep accurate time records of time actually worked by its employees in violation of the Fair Labor Standards Act “FLSA” and state wage and hour laws. Plaintiffs are seeking to recover unpaid wages, liquidated damages and attorneys’ fees.
