
A class action is a lawsuit brought by one or more plaintiffs on behalf of a large group of others who share common claims and damages. The subject matter of class action lawsuits can vary widely. Some examples of cases commonly pursued as a class action include:
- Employees of a corporation who have suffered from the same unlawful pay practices including the failure to pay overtime;
- Consumers who were victims of unfair business practices, fraud and other deceptive conduct; and,
- People who were injured by the same defective product including unreasonably dangerous medications.
To pursue a class action, there must be common questions of fact and law shared by all class members and the number of individuals affected must be large enough that it is impracticable to bring their claims individually before the court.
Class actions benefit the plaintiffs and general public in many ways. First, they make it easier for the individual to seek compensation by sharing costs among all class members. Second, they provide equal justice among all members of the class. Lastly, they protect consumers by discouraging companies from committing wrongful acts or deceptive practices in the future. Class actions are an effective way to balance the scales by providing a means for ordinary persons, even those with limited resources, to seek justice against multi-million dollar corporations and other powerful entities.
