On December 16, 2011, we filed a lawsuit against Defendants, PNC Mortgage Company and PNC Bank, N.A. (collectively "PNC"), on behalf of loan officers seeking to recover unpaid overtime compensation. The lawsuit charges that PNC violated state and federal law by misclassifying its loan officers as exempt; failing to keep complete and accurate time records; and, failing to pay wages earned as required by state and federal law.
Under federal and state law, employees are entitled to wages for all hours worked and time-and-a-half premium pay for time worked over 40 hours in a workweek. These laws also require employers to maintain accurate records of hours actually worked by its employees.
In this case, Plaintiff alleges that she and other Loan Officers were not exempt from state or federal law and that they regularly worked overtime hours in excess of 40 per week selling mortgage loans and performing other work without overtime pay.
