Our firm represents current and former servers, bartenders and other “tipped employees” of Cheddar’s Casual Café (“Cheddars”) who allege they were wrongly deprived of minimum wages, overtime wages and earned tips. Plaintiffs claim that Cheddar’s violated the federal Fair Labor Standards Act (“FLSA”) by: (1) requiring its tipped employees to participate in an illegal “tip pool”; (2) unlawfully altering employee time records to avoid paying them for all time actually worked; and, (3) requiring, encouraging and permitting its employees to work without pay before they clocked in and after they clocked out. We are seeking the recovery of all unpaid back wages, liquidated damages and attorneys’ fees on behalf of our clients.
